Symbols can only be trademarked for commercial use.
Symbols of a not-for-profit organization can be trademarked, as well.
But, you can copyright a
design as a work of art. If HPB drew the original design on a piece of
paper, it could be copyrighted without any need to register it.
Now, it can. At that time, it couldn't, but, even if it was, it would
have lapsed into the public domain by now.
